Sean ‘Diddy’ Combs’ legal team have filed for an acquittal or a retrial. The disgraced rapper was found guilty of transportation to engage in prostitution, relating to ex girlfriend Cassie Ventura and another woman referred to as Jane.

Earlier this month, he was found not guilty of racketeering and of sex trafficking Ventura and Jane. He dropped to the floor as the verdict, decided by eight men and four women, acquitted him of the most serious counts.

The court heard how he flew people around the country, including his girlfriends and paid male sex workers, to engage in sexual encounters, a felony violation of the federal Mann Act. It comes after Combs was denied bail following the end of his two-month long trial.

The Combs team stated in a statement released to the Mirror that this case was unprecedented. This verdict is incorrect. And this conviction, which is based on an excessively broad, misapplied statute, should not stand.

Combs’ attorneys have argued that he did not violate the Mann Act in court documents from this week. It is against the law to transport someone across state lines for unlawful sexual activity, according to federal law.

“To our knowledge, Mr. Combs is the only person ever convicted of violating the statute for conduct [for] anything like this,” the motion states according to Page Six.

It goes on to say that it is undisputed that he was acting in a mature manner and that no one else was hurt. The men made the voluntarily-chosen decision to travel and participate in the activity.

The jury’s decision confirms that during the Freak-Offs or hotel nights, the women weren’t sexually assaulted, abused, or otherwise vulnerable. Additionally, Mr. Combs has never engaged in sexual activity with the alleged “prostitutes.” “

They continued, claiming that Combs “generally employed male escorts or dancers” for “Freak-Offs with Ventura and Jane” promotions made public through legitimate businesses.

The men were not just traveling to get sex for money, the motion claimed, and they enjoyed the activities and formed friendships with Ms. Ventura and Jane.

Combs’ attorneys argued that his First Amendment rights are violated by the partial conviction. According to the documents, “He or his girlfriends typically recorded the Freak-Offs and hotel nights for their own enjoyment,” and that is what they do frequently.

Since the movies featured adults engaging in consensual behavior, Combs claimed he was “producing amateur pornography for later private viewing.”

Due to the significant spillover prejudice caused by the volume of inflammatory evidence, Combs’ attorneys said if an acquittal was denied, they would like a retrial.

They made reference to 2016 video that was retrieved from hotel CCTV that showed Combs attacking Ventura. According to the filing, this evidence, particularly the Intercontinental footage, was admissible only because of the RICO and sex-trafficking allegations.

Because it was unjustly prejudicial and irrelevant, it would never have been allowed to stand trial solely based on the Mann Act counts. A new trial with only admissible evidence to support the Mann Act charges is necessary under the Second Circuit’s ” retroactive misjoinder” doctrine.

Combs is currently awaiting his sentencing while he is in jail. October 3 is the expected date.
