Import License: Court Strikes Out NNPCL’s Request To Dismiss Dangote’s Suit

The Nigerian National Petroleum Company Limited (NNPCL), whose preliminary objections are related to Dangote Petroleum Refinery and Petrochemicals’ (NNPCL) legal standing, has rejected Justice Inyang Ekwo’s ruling in the Federal High Court in Abuja.
Justice Ekwo ruled that the NNPCL opted to file a preliminary objection rather than a counteraffidavit against Dangote Refinery’s lawsuit, contrary to the applicable laws governing court proceedings.
The court may address the issue of jurisdiction at the time of judgment, the judge added.

He criticized the NNPCL for “incompetent preliminary objection” to the refinery by violating Rule 16 of the Federal High Court.
Justice Ekwo further stated that if Dangote Refinery amended its lawsuit, NNPCL would not face any legal issues.
Justice Ekwo cited the refinery’s amendment lawsuit as being grantable in light of Dangote Refinery’s request to amend its lawsuit to properly cite the name of the NNPCL.
