Court To Hear Motion Seeking To Strike Out LP’s Defection Suit Against Rivers Lawmakers

A motion to revoke the defection lawsuit brought by the Labour Party (LP) against Martin Amaewhule and 26 other Rivers State House of Assembly will be heard on Monday in a Federal High Court in Port Harcourt.
K. Njemanze (SAN), the Rivers State House of Assembly’s attorney, informed the court that he had requested a hearing on March 10 to order the case to be dropped.
Njemanze claimed that the Supreme Court’s decision on February 28, 2025, had already resolved all of the lawsuit’s issues.
He argued that the Federal High Court had a duty to follow the Supreme Court’s order in light of Section 287 (1) of the 1999 Constitution (as amended).

The motion was opposed, however, by Clifford Chuku, Labour Party’s (LP) attorney.
He claimed that he had filed a response on legal issues, arguing that the Supreme Court’s decision did not address the issue at issue, which was the transfer of power from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).
Chuku added that the Federal High Court has exclusive jurisdiction over defection cases involving House of Assembly members under Section 272 (3) of the 1999 Constitution (as amended).

The motion was then adjourned until Monday, March 17, 2025, at 2:00 PM for hearing.
