Burkina Faso bans homosexuality as a crime punishable with prison, fines

The state broadcaster claims that the government of Burkinabe has passed a law that forbids homosexual behavior and sentences those found guilty to two to five years in prison.

71 unelected members of the nation’s transitional government, which has been in place since the military seized control of the country after two coups in 2022, unanimously passed the draft law on Monday.

Edasso Rodrigue Bayala, the justice minister, made the announcement regarding the national broadcaster RTB, adding that those who violated the law would also be subject to fines and prison time.

He said, “If a person is a victim of homosexual or other bizarre behavior, they will go before the judge,” noting that foreigners are prohibited from being deported under the law.

The new law is anticipated to take effect right away.

Officials predict that the most recent law will be “popularized through a campaign” as part of Burkinabe’s wider reform of family and citizenship laws.

Rights activists are likely to criticize the limitations on legal recourse in cases involving nationality and the new legislation.

Soldiers have stated their plans to stabilize the nation as a result of the country’s worsening security crisis and improve governance since the military took control in 2022.

However, human rights organizations have accused the military administration of repressing the country’s laws through widespread arrests and military repression.

More than half of African nations punish homosexuality with either prison sentences or the death penalty, making Burkinabe the latest country to do so.

In November of this year, Mali, a neighboring nation and ally, passed laws criminalizing homosexuality.

Ghana and Uganda have recently strengthened their anti-homosexuality laws, drawing a lot of criticism.
