The Attorney General of the Federation (AGF), Lateef Fagbemi, has asked Governor Ademola Adeleke of Osun State to put the local government election scheduled for Saturday, February 22, 2025, on hold.
According to the justice minister, the Court of Appeal, Akure division, on February 10, 2025, nullified the judgement of the Federal High Court, Osogbo, delivered on November 25, 2022.
The appellate court’s decision, according to the AGF, implied that the All Progressives Congress (APC) local council chairmen had been reinstated following their sacking by the lower court.
Since Monday, when APC and PDP members clashed in Osun State over local government council control, at least six people have been confirmed dead.
The state governor, Ademola Adeleke, warned the public on Sunday that APC members supported by security forces wanted to occupy the state’s council secretariats.
The governor, who belongs to the Peoples Democratic Party (PDP), had also asked President Bola Tinubu to caution one of his ministers, Gboyega Oyetola of the APC, over the impending clash.
Sowunmi To FG: Perish Plans To Declare Osunne State of Emergency
According to Fagbemi, “the decision of the Court of Appeal effectively restored the elected Local Government officials who had been removed by the Federal High Court to their offices.”
Some disgruntled individuals objected to the attempted return to their positions in response to the facts that were made available to my office.
Ademola Nurudeen Jackson Adeleke, the governor of Osun State, is undoubtedly aware of this scenario and should have called the angry elements to order in accordance with his Oath of Office in order to uphold law and order in Osun State.
His Excellency has insisted that a new Local Government election be held on Saturday, February 22nd, 2025, in contrast to the Court of Appeal’s decision, which in effect means that the term of office of the elected officials has regained currency and will naturally expire in October 2025.
Any such election that may be held will not only be invalid because the terms of office of the elected officials that were just reinstated by the Court of Appeal will continue until October 2025, but it will also constitute an egregious constitutional violation, which Governor Adeleke has sworn to uphold.
