Court Strikes Out Defamation Charge Against Farotimi

Dele Farotimi, a lawyer and author based in Lagos, was charged with a criminal offense by the Federal High Court sitting in Ado Ekiti.

Following a request from Samson Osobu, the police prosecutor, Justice Babs Kuewumi decided to drop the charge.

Osobu claimed that the prosecution had filed a discontinuance notice.

He said, “the matter is slated for hearing today, but we have filed a notice of discontinuance dated January 29, 2025, and filed this morning”.

There was no objection from lawyers to Farotimi led by Senior Advocate of Nigeria, Adeyinka Olumide-Fusika.

This made it easier for Justice Kuewumi to declare, “This case is hereby struck out,” and the judge did so.

Olumide-Fusika declined to comment on other court-pending matters but stated to journalists that the case had been settled in this particular court.

He added that he had given Farotimi advice against giving the subject press interviews.

Remember that the Magistrate Court, which is located in Ado-Ekiti, is still hearing arguments against Farotimi, a second criminal charge brought by the police against him.

The police are anticipated to move to stop the proceedings in that court and drop the charge as soon as the case is adjourned until February 13, 2025.

Attorneys in those states’ Afe Babalola Chambers filed civil cases against Farotimi in those states as well.

In some jurisdictions, interim orders were made to prevent Farotimi or anyone else using his book, “Nigeria and its Criminal Justice System,” from further printing, publication, and sale.
