Court Stops Police From Tendering DNA Test Result Against Ex-Minister Turaki

Kabiru Turaki, a former special duties and inter-governmental affairs minister, was prevented by Justice Inyang Ekwo of the Federal High Court Abuja on Tuesday from submitting a DNA test results to Justice Inyang Ekwo.

Hadiza Baffa and Turaki are at odds with one another regarding paternity.

Justice&nbsp, Ekwo gave the order after counsel for the NPF, Inspector-General of Police and DCP Rita Oki Oyintare, M. L Anthony, who are 1st to 3rd respondents respectively, sought an adjournment to enable them to comply with the earlier court order.

Through his attorney, Abdulaziz Ibrahim (SAN), Turaki’s lawyer, had informed Justice Ekwo that the police planned to file a criminal charge against him in Abuja against him in the form of a statement in which he claimed the test result “provided in violation of his fundamental human rights.”

Justice Ekwo, who requested on February 18 to stop the police from presenting the DNA test results in the paternity dispute with Hadiza in another court, turned down the former minister’s application.

The judge, in a ruling on an ex-parte motion, moved by Ibrahim, held that he could not grant the relief sought by the former minister without hearing from the respondents.

Therefore, the judge ordered Turaki to give notice to all the applicants within two days of the order and to demand that the respondents give justification for why the ex-minister’s request for prayers should not be granted.

When the matter was called, Ibrahim, who appeared for Turaki, informed the court that the matter was for the respondents to show cause why his client’s prayers should not be granted.

However, the senior lawyer claimed that the first to third respondents had refused to sign an affidavit demanding cause.

He said instead, they filed a joint counter affidavit to their substantive application.

Ibrahim said Hadiza, who is the 4th respondent, filed an affidavit to show cause and a counter affidavit to their main suit.

The applicant’s motion was then answered by Justice Ekwo, who responded that they had filed a counteraffidavit.

The judge frowned at his response and Anthony, therefore, sought an adjournment to enable them to do the needful.

The parties confirmed that they had filed a counteraffidavit and an affidavit to the originating motion by Usman Chamo, who had appeared for Hadiza and whose daughter’s paternity is being contested by Turaki.

If not for the 1st to 3rd respondents, I would have taken this matter now and determined everything together.

“Look at what he has done as he has asked for adjournment”, the judge said.

Justice Ekwo, who granted Anthony’s application for adjournment, restrained all the respondents from taking any step which might affect Turaki’s prayers on the motion ex-parte.

He further stated, “I also make an order that the respondents not to do anything in opposition to the prayers on the motion ex-parte until this court’s further orders are issued.”

The judge also mandated that the applicant respond before the following adjourned date and that the police file all necessary paperwork.
