Court rejects Australian soldier’s defamation appeal over Afghan killings

Australia’s most decorated living war veteran has lost an appeal against a civil court ruling that implicated him in war crimes while serving in Afghanistan.

Australia’s Federal Court dismissed the appeal lodged by Ben Roberts-Smith on Friday, in the latest setback for the 46-year-old’s fight to salvage a reputation tattered by reports that he took part in the murder of four unarmed Afghan prisoners.

Three federal court judges unanimously rejected his appeal of a judge’s ruling in 2023, which said Roberts-Smith was not defamed by newspaper articles published in 2018 that accused him of a range of war crimes.

In the earlier ruling, a judge had found that the accusations were substantially true to a civil standard and Roberts-Smith was responsible for four of the six unlawful deaths of noncombatants he had been accused of.

Delivering the appeal court’s verdict, Justice Nye Perram explained that the reasons for the decision are being withheld due to national security implications that the government must consider.

The marathon 110-day trial is estimated to have cost 25 million Australian dollars ($16m) in legal fees that Roberts-Smith will likely be liable to pay.

He has however said he will fight to clear his name in Australia’s High Court, his last avenue of legal appeal.

“I continue to maintain my innocence and deny these egregious spiteful allegations,” Roberts-Smith said in a statement. “We will immediately seek to challenge this judgement in the High Court of Australia.”

Tory Maguire, an executive of Nine Entertainment that published the articles Roberts-Smith claimed were untrue, welcomed the ruling as an “emphatic win”.

“Today is also a great day for investigative journalism and underscores why it remains highly valued by the Australian people,” Maguire said.

Australia deployed 39,000 troops to Afghanistan over two decades as part of United States and NATO-led operations against the Taliban and other armed groups.

Perth-born Roberts-Smith, a former SAS corporal, had won the Victoria Cross – Australia’s highest military honour – for “conspicuous gallantry” in Afghanistan while on the hunt for a senior Taliban commander.

An Australian military report released in 2020 found evidence that Australian troops unlawfully killed 39 Afghan prisoners and civilians. The report recommended 19 current and former soldiers face criminal investigation.

It’s not clear whether Roberts-Smith was one of them.

Police have been working with the Office of the Special Investigator, an Australian investigation agency established in 2021, to build cases against elite SAS and Commando Regiments troops who served in Afghanistan between 2005 and 2016.

The Age, The Sydney Morning Herald and The Canberra Times said in a series of reports in 2018 that Roberts-Smith had kicked an unarmed Afghan civilian off a cliff and ordered subordinates to shoot him.

Chris Brown remanded in custody over alleged nightclub assault as trial date set

Singer Chris Brown has been remanded in custody after he was arrested in Manchester yesterday. The American musician, 36, was charged with grievous bodily harm with intent by the Metropolitan Police.

He had arrived at a five-star hotel in the city before his arrest at 2am on Thursday. Brown flew into Manchester on a private jet on Wednesday and was staying at The Lowry Hotel in the city.

After discovering he was in the country, the Metropolitan Police travelled to Manchester where they arrested him over an alleged assault in a London club two years ago.

In an update, Brown has been remanded in custody until June 13 by a judge in Manchester over an allegation of causing grievous bodily harm with intent.

The Met spokesman said: “A 36-year-old man was arrested at a hotel in Manchester shortly after 02:00hrs on Thursday, 15 May on suspicion of grievous bodily harm. He has been taken into custody where he remains.

“The arrest relates to an incident at a venue in Hanover Square on 19 February 2023. The investigation is being led by detectives from the Central West Area Basic Command Unit.’’

On Thursday evening, Adele Kelly, the Deputy Chief Crown Prosecutor for CPS London North, said: “We have authorised the Metropolitan Police to charge Chris Brown, 36, with one count of grievous bodily harm, contrary to section 18 of the Offences Against the Person Act 1861.

“The alleged incident occurred in London on February 19 2023. He will have his first court appearance on Friday May 16 at Manchester Magistrates’ Court.

“The Crown Prosecution Service reminds all concerned that criminal proceedings against this defendant are active and that he has the right to a fair trial.

“It is extremely important that there should be no reporting, commentary or sharing of information online which could in any way prejudice these proceedings.”

Brown is set to play ten shows across the UK and Ireland in June and July for his 2025 Breezy Bowl XX tour, which starts in Manchester and ends back in the city. He is due to perform in Cardiff, London, Birmingham, Dublin and Glasgow.

P Diddy trial LIVE: Cassie Ventura to be quizzed again as cross-examination continues

Cassie Ventura is set to be quizzed by defence lawyers again as Sean ‘Diddy’ Combs’ trial continues. The disgraced rapper, 55, has been in court all week as he faces a number of charges, including racketeering conspiracy, sex ­trafficking by force, fraud or coercion and transportation to engage in prostitution.

He was arrested in September and strongly denies all allegations made against him. Combs has been in prison since his arrest, with a number of bail requests rejected.

His former partner of 10 years, Cassie Ventura has been on the stand most of the week. Defence lawyers started their cross-examination of Cassie on Thursday and will continue on Friday.

Judge Arun Subramanian became frustrated at Combs’ legal team over the time they are taking to question Cassie, who is eight-months pregnant.

He insisted the defence should be given no more than a day and a half—the same amount of time the prosecution had. On Thursday, Cassie broke down in tears toward the end of her testimony.

During Thursday’s session, Combs appeared uber relaxed as his unearthed text messages with Cassie were read out to the jury.

Cassie feared Diddy’s ‘jealousy’ over fling

Cassie told the court about her past relationships yesterday as defense attorney Anna Estevao turns the conversation to Combs’ own jealousy.

She agreed that Combs could be more jealous than her and would lose his temper when he suspected she was seeing other men.

The court heard Cassie and Scott Mescudi, better known as Kid Cudi, briefly dated during a rough patch in her on-and-off relationship with Combs, which spanned from 2007 to 2018.

She said Combs learned of her romantic involvement with Mescudi in December 2011 when she said the relationship with Combs was strained and they were “on a break.”

She also revealed she had a “burner phone” to communicate with Kid Cudi. “I did not want him to find out,” Ventura told the court. “I thought it would be way too dangerous if he found out.”

“Because he would be insanely jealous?” Estevao asksed “Yes,” Cassie replied.

Britney Spears dragged into case

Pop star Britney Spears was mentioned in court yesterday. The jury were shown text messages between Combs and Cassie over the years.

These included messages about Freak Offs and threats allegedly made by Combs. Cassie testified that Diddy brought pop star Britney to her 21st birthday party in Las Vegas.

He also allegedly invited singer-songwriter Dallas Austin to the celebration. At the time, Cassie was already signed to Diddy’s record label, and she told the jury that their relationship had been strictly professional—until that night.

During the party, she said, Diddy kissed her, leaving her confused.

Cassie accused of being ‘insanely jealous’

On Thursday, Combs’ legal team spoke of his children.

Defense attorney Anna Estevao said Cassie was “upset” that she didn’t get to build a relationship with them. Cassie told the court: “It could be [heartbreaking],” when asked how it felt to see Combs with Kim Porter and their children.

She confirmed she wanted to be part of his family—not just, as Estevao put it, his “sexual fantasy.”

The defense brought up another woman Cassie previously said she discovered through social media, asking whether that woman was “the main problem” in her relationship with Combs. “Yes,” Ventura responded.

“You were concerned you were a side piece, that you were not the main girlfriend,” Estevao said. “You were insanely jealous.”

Diddy’s overdose

Cassie told the court that Combs noticed the negative effects her drug use was having on her and encouraged her to see a doctor. She also said there were moments when he expressed concern for her mental health.

In a striking revelation, she confirms that Combs himself suffered an overdose on opiate painkillers while at the Playboy Mansion in 2012.

Diddy’s whisper caught on mic

Combs’ comment to his lawyer was caught on a hot mic in court during his trial yesterday.

He told Anna Estevao he was “proud” of her work, a remark he appeared to understand would go unnoticed in the courtroom in New York City.

Cassie may return next week

Subramanian pointed out that both parties had previously agreed Cassie’s testimony would conclude by the end of the week, noting that she is currently pregnant and expecting her third child soon.

In response to the shifting schedule, the judge remarked: “That is the exact opposite of what I was told.”

What is happening today?

Cassie Ventura will take to the stand again as Combs’ defence team continue their cross-examination. They were warned by the judge to not take more than a day and a half—the same amount of time the prosecution had.

“In what universe did you not understand this is what was going to happen?” Judge Arun Subramanian asked. “You’re not telling me this was everyone’s understanding, that this witness was going to be done this week?”

Rashford To Miss Last Two Games Of Aston Villa’s Season

Marcus Rashford will miss the rest of Aston Villa’s season after being ruled out of Friday’s match against Tottenham Hotspur.

Rashford’s hamstring injury will keep the loan signing out of Villa’s last home game and, with their final match coming against parent club Manchester United on May 25, it means the England forward’s campaign is over.

The 27-year-old has been sidelined since last month and missed Villa’s 3-0 FA Cup semi-final defeat by Crystal Palace.

His future remains in doubt, with Birmingham club Villa having a £40 million ($53 million) option to turn his loan move into a permanent deal.

There are reports Rashford wants to play Champions League football next season, with Villa yet to secure a place in European club football’s premier event.

Youri Tielemans has also been ruled out of Friday’s match at home to Europa League finalists Tottenham.

“Youri and Marcus are not available and Jacob Ramsey is suspended,” Villa manager Unai Emery said Thursday.

“We have to do each step forward, testing and analysing how they are recovering.

“I don’t know if they will be available physically (next week), because Marcus can’t play next week.

“But they are working every day and they are feeling better.”

The Tottenham game was moved to Friday night following Spurs’ request for more time to prepare for Wednesday’s Europa League final in Bilbao against another Premier League team in Manchester United.

Villa were not happy with that decision and concerns have been raised that Spurs’ priority on Friday will be to avoid injury.

But Emery expects the north London club, a lowly 17th in the Premier League table, to be competitive at Villa Park.

“They are trying to manage to play Premier League and Europa League, how they are performing in the Europa League is really fantastic,” the Spaniard added.

“They are in the final… they are going to play with their better players, they are going to try and compete in getting the best performances to get ready for the final.”

Sixth-placed Villa are chasing Chelsea, Manchester City and Newcastle as they bid to secure Champions League qualification for a second successive season, with the top five from the Premier League entering next term’s event.

“I wish to play, I don’t want holiday because we are in a very good moment after a long season,” Emery said.

“Now we are very, very motivated, very excited to play in Villa Park tomorrow (Friday) for our objectives we have in front of us to play again in Europe.

“It is not in our hands, but we can have some chance to play Champions League again. We are focusing on Tottenham.”

Irish international Burns among Munster departures

Fly-half Billy Burns will leave Munster at the conclusion of the 2024-25 season.

The former Gloucester player joined the province last summer after spending six seasons with Ulster.

The 30-year-old has won seven caps for Ireland having made his debut against Wales in 2020.

Munster, who will be under new head coach Clayton McMillan next season, have also confirmed that Scott Buckley, Patrick Campbell, Liam Coombes, Jack Daly and Cian Hurley will depart Thomond Park once the season has concluded.

It had previously been announced that Peter O’Mahony, Conor Murray, David Kilcoyne and Stephen Archer are also in their last seasons with the side.
