Rivers: SERAP Sues Tinubu Over Suspension Of Fubara, Deputy, Lawmakers

The Rivers State Governor, Siminalayi Fubara, his deputy, Ngozi Odu, and members of the State House of Assembly have been sued by President Bola for what it claims to be an “unlawful suspension.”

The oil-rich state’s governor and other elected officials were suspended for an initial six-month suspension last Tuesday by President Tinubu.

He cited as evidence for his actions “the disturbing” violence in the state over the past 24 hours, which included oil pipeline explosions and vandalization, as well as political unrest there.

The President’s decision, which has received criticism from opposition leaders, the Peoples Democratic Party (PDP), the Nigerian Bar Association, and erudite lawyers, was based on Section 305 of the 1999 Nigerian Constitution.

SERAP claimed in a statement on Sunday that the decision harmed democratic governance and violated constitutional rights.

The organization reported that it had filed with the Federal High Court in Abuja on Friday via the volunteers’ lawyers network (SVLN) in Rivers State, including Gracious Eyoh-Sifumbukho, Nengim Ikpoemugh Royal, and Yirabari Israel Nulog.

If the people’s constitutional right to participate can be arbitrarily revoked or violated, the rule of law would be a mere figure of speech, according to SERAP Deputy Director Kolawole Oluwadare.

The rule of law is rooted in democracy, according to the author. The statement read, “Nigeria’s democracy should have as its foundation respect for the rule of law and human rights.”

According to the group, the suspension goes against both the African Charter for Human Rights and the African Charter for Democracy, Elections, and Governance, in conflict with the Nigerian Constitution and international legal obligations.
