Lyle and Erik Menendez ‘could be free in weeks’ 35 years after murder of parents
In a few weeks, Lyle and Erik Menendez may be free of jail.
The brothers are serving a life sentence without parole for the 1989 shooting deaths of their father and mother, Jose and Kitty Menendez, who recently re-entered the spotlight thanks to Netflix’s Monster: The Lyle and Erik Menendez Story.
After a trial in 1996, when Lyle was 21 and Erik was 18, Lyle and Erik were both sentenced to prison. They are now 56 and 53 years old respectively. After years of sexual, physical, and emotional abuse from them, they both claimed to have killed their parents for self-defense.
Last week, prosecutors said the brothers should be resentenced. Los Angeles County District Attorney George Gascon said: “Under the law, resentencing is appropriate. I’m going to recommend that to a court tomorrow”. He promised to submit a judge with that recommendation. If a judge accepts the recommendation, the brothers might be eligible for parole right away, according to LA DA Gascon.
The brother’s release from prison on December 11 has been reported as well. The brother’s attorneys are scheduled to appear in court on December 11 for hearing whether or not they could be freed after decades in prison, according to sources who spoke to TMZ.
According to the sources, the hearing date scheduled during a Wednesday meeting between the brother’s defense team, prosecutors and the new judge assigned to their case, Michael V. Jesic. The attorney representing the brothers, Mark Geragos, also told the publication that he is filing documents asking Gavin Newsom, the governor of California, for clemency.
“We have dual-tracks. I am doing everything possible”, he said. He desired that the brothers would attend Thanksgiving and other family gatherings. “I’ve said publicly, I want them home not just for Thanksgiving but for Joan’s 93rd and to celebrate with Aunt Terry as well”, he added.
Ryan Murphy’s Monster, a Netflix original series, thrust the brothers back into the spotlight once more. The events that Jose and Kitty Menendez’ sons shot dead in 1989 were covered in The Lyle and Erik Menendez Story. Additionally, it followed the events of the subsequent murder trials, in which the siblings were ultimately found guilty of murder. The siblings testify that their father sexually abused them, terrified of their lives, and ultimately killed him and their mother as a result.
Cooper Koch, who played Erik in a controversial episode of the controversial series, was the subject of an episode about the horrifying abuse his father suffered. Erik claimed that when his father assaulted him, he started eating lemon with all of his food to make it “feel better.”
