The first count dates to his time as mayor of Davao City, where he is alleged to have allegedly been an “indirect co-perpetrator” in 19 murders between 2013 and 2016.
His tenure as president is the subject of the second and third ICC charges. The first refers to the deaths of 14 so-called “high-value” targets in 2016 and 2017, while the latter mentions 43 murders committed between 2016 and 2018 while conducting “clearance” operations against lower-level alleged criminals.
According to the ICC report, the 76 murders were committed by police as well as non-state actors, including hitmen.
A court delayed Duterte’s appearance at the ICC later this month after the charges were published several weeks prior.
Following Nicholas Kaufman’s suggestion that the case should be indefinitely delayed because of Duterte’s poor health, the court must first assess the former president’s suitability to decide whether he is fit to go on trial.
According to Kaufman, Duterte is experiencing “cognitive impairment in multiple domains.”
Duterte was detained on March 11 in Manila, the capital of the Philippines, and immediately flown to the Netherlands, where he is currently being held in ICC custody. The 80-year-old claims that his arrest was unlawful.
